I was on I-485 status on my EB3 application working on EAD. My I140 for Eb2 application got approved today while also requesting porting of priority date.
I believe USCIS would have automatically switched the 485 application to use the new EB2 I-140 instead of old EB3-I140
Now my question I am ready to renew my EAD. I wanted if there will be any problem with my EAD application since it is now transfered to an Eb2 position.
My pririty date is still not current....
EAD is based on a pending I-485, you should go ahead to renew your EAD (as you work in EAD, do not let it expire). Consult a lawyer, send additional documentation along with the package that you have done so-and-so transfer.

Folks,
How are the taxi charges from Chennia airport to the town or station ? Do the drivers charge whatever they feel like or is it controlled?
My parents are leaving back from the US and will be landing in Chennai, they are not from Chennai....so not sure if I should try to book a taxi before hand...or the charges are controlled ? Also, do they have something like pre-paid taxi ?
The flight (emirates) lands at 3 or 4 am.
Also, any recomendations for Hotels ? Ideally near the railway station.

Transferring cases saying that it is to speed up processing which essentially delays processing maing us wonder if it is a time buying tactic to cover inefficiecy.
An application filed in August if not transferred to NSC would have had ND and RD as August, but now it has Oct. Rubbing salt on the wound NSC is processing 2006 and 2007 cases and not picking 2004 cases.

If you are filed in EB2, you can file I-485 and I-140 concurent after getting the PERM approval using cross charge. (EB2 ROW is always current). If you are in EB3, you need to wait 3-4 years to file I-485. (Long wait).

My wife is on H4 and is planning to convert to F1 before joining graduate school to get scholarship. At same time my PERM is filed and once approved i was planning to use cross chargebility to file under my wife country of birth quota (UAE). i wanted to know following
a) if she applied for conversion for F1 today, can she get scholarship before she gets ssn or she has to wait till she gets ssn
B) If during her F1 processing time or grauate studies on F1, if my PERM gets approved, can i file for I-140 and I485 using cross chargebility with her being on F1 or i would have to wait for her to conert to H4? If there any risk to our green card processing
C)If she continues on H4 visa, can she still get scholarship? if not once she graduates would she be in special US master degree quota for H1B?
Any help on these would be great

So, this so called nice card...how does it come?
I know its by USPS , but do they need you to sign or something... ?when you get the cover or package, ...or will it be sitting in the mail box one fine day sometime after ones case is approved ?
I might be out of the country perhaps when the card comes, (if I am lucky and my case is attended to by the authorities in July) .... (I will come back on AP)
Intially I was thinking of putting a hold on my mail in the post office...but my lawyer said that USPS sometimes returns mails from USCIS (which could be H1, EAD, AP, GCs, etc...)
So now am thinking I will request my neighbour to hold my mail for me....but am wondering if a signature is needed if the card comes during my absense....

I agree with the monetary clout aspect of the argument and would participate in such an effort. I also feel we have to initiate high visibility events on the lines of the DC event. Two suggestions I would like to float,
(1) Can state chapter memberships be made paid for with annual memberships. There are efforts to channelize information through the state chapters (and rightly so) - there could be others such benefits that can be made available in due course.
(2) Can we extend/magnify the entrepreneural theme of IV (beyond a discussion thread) by having a substantial program dedicated to the entrepreneurship aspirations of a good number of IV members - have a business plan competition amongst members, garner support of successful immigrant entrepreneurs as part of the program, have webinars to educate legal aspects and barriers faced (due to our limbo). In essence, make visible the entrepreneural potential locked. Also, it might help transform our image from job takers to job creators. We can partner with other entrepreneural support organizations to fund the program. If we can execute a truly great Business Plan competition and attract venture capital funds we can have certain percentage of venture funding go to IV. If IV members and core think that this suggestion has some merit, I can help evaluate/extend/shape the idea with other like minded individuals.

Yep..they just noted that I came for the initial appointment and asked to come after my finger heals..i had surgery on the finger and went back after the finger healed
If you dont mind telling me, which ASC you went to ? can you give the city and state? Also when they put a note on the FP notice , do they return the original FP to you or they keep it. The reason I am asking is I am thinking of doing a walk-in at some other ASC in case the original ASC asks to reschedule instead of doing walk-in after healing. So I will need the original FP appointment if I goto some other ASC. My wife has some travel plans in coming 2-3 weeks and want to get this out of the way.

Same aberration here!
My last LUD was 10/03 and was saying something like: "in response to your inquiry we mailed you bla bla bla..."
Today 10/30 I got a new LUD but the message has reversed to what it was before: "In October 18 2005, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made." and I just got confirmation ...with 5 e-mails!!!:confused: :confused: :confused:
Anyone has any idea of what this means or is it just another "glitch" of their crazy software?

by the way the reason that strobe is tricky (I didn't say on previos post). is that you can't see the exact efect of the lighting through the camera

I had to go through secondary inspection which took about 20 minutes at JFK.IO only verified and stamped AP. No other documents were requested. To be on safe side, I carried Pay Stubs, Education Documents and Office Identification card.

I guess you need to do some serious reading about the entire process and especially your scenario. Just google, you'll be inundated with ocean of information. Then you may have some idea about the time frames of getting the EAD or GC or Citizenship or whatever. Good luck!

In addition to that, there is a 90% chance that there will be an inquiry from USCIS when change of status petition (B1/B2 to H1) is filed, mostly asking the routine questions and the query would have to be replied by a good attorney in a proper manner.
That would cost your friend here some money as replying the USCIS inquiries is pretty routine but its not free and lawyers would charge you $$ for that. If you are doing this thru a small company, the company might charge you / your friend here for reply to the USCIS query. It would be a minimum of $1000 to respond to such inquiries by an average attorney.
Its better to go to India, get a fresh H1 approval (I-797) for yourself, get the visa stamp of H1 on your passport in India and then come here. You wont be able to start working until Oct 1 anyways.
Also, please dont open 2 threads for the same question. I am going to delete the other thread.

With the elimination of labor substitution, I am sure USCIS will investigate all existing labor substitution applications too. So if I were you I would not move to the new company before I-140 is approved.

You or your wife's country of birth is important factor in whether you will save much time by being EB-2. If you are from China, your EB-2 priority date (PD) would be about 2.5 years ahead of the EB-3 date. However, since it could take 2 years to get a new PERM and I-140 approved, it wouldn't save much time. For India and other countries that are current, the difference might be worth it. Of course, your employer has to be willing to go through the work and expense of redoing PERM and the I-140, and must have an EB-2 position available for you.

I think #1 and #2 are problematic as there is a lack of contrast or color difference between the field and the fence, it takes a while to see what's in the picture.
#3 and #4 work better, something interesting in the foreground and context from the background. Both have a slight tilt to the right though which is distracting to me. One rule of thumb is to work with thirds, the horizon in #3 cuts the picture in half which isn't wrong but many seem to prefer the 1/3 - 2/3 composition in #4. The foreground could be a bit sharper perhaps but #4 is my favourite of the four, nice picture.

I also called the number 202-224-7703. The lady told me that, it is scheduled for hearing this fall and we can check on Website judiciary.senate.gov . She said, usually they post the date, 1 week before the hearing in the committee. She is also told that, she is going to pass on the message for hearing, to the senators.
