    Yes, your company can do that, however this can only be done for a period of 1 year.

    This is what most of the consulting firms do...if you see most of their projects are never more than 1 year. This is a way to save taxes for employees and employer.

    However, after 1 year you cannot claim any expenses. if the company allows it, then they will be in trouble and not you. Otherwise, find another project at least 50 miles away from your current location.

    So what your company is doing is legal....

    I wish my company attorney could understand the basic ENGLISH instructions. Worst part, still doesn't admit his mistake and keeps pointing to the receipt issued by USCIS.

    Btw, I took Infopass appointment and went today to ask what should I do....given USCIS has issued receipt notice
    The officer responded similar to my attorney's response, stating given that USCIS has issued receipt, they are working on my appl and I may not need to send the fee..BUT he admitted that the fee was required..
    In short, still not sure what to do....

    I think both your attorney and the Infopass official are right. The app fee is part of the initial evidence (documents) that are verified before the case is accepted. Since the receipt has been issued it seems the receipting agent has overlooked that the fee was required. But again, this is USCIS that we are talking about!!

    Just my 2c and not a recommendation one way or the other!!

    I agree. Everyone wants to sit in front of computer & IV forum and watch what good can come to them of this. Everyone needs to roll-up their sleeves, contact friends, spread awareness etc.

    It is hard to say. I am in the same situation as you (filed concurrently by June 21). I believe it is not worth giving them an extra $1000, and for what. You already have filed your I-485. What is the downside?

    I know someone who went to Canada for the weekend and got the I-94 with the correct date on it.
    Note that the airline (AA), on his way out of the US, was not willing to take his I-94 since he was going for less than 30 days. So he had to explain to them about his situation and they took it.

    Also note that if you have an Indian passport, you will need a visa to go to Canada.

    The other option to extend your I-94 is for your employer to refile I-129, and request for extension of stay. This can be done using premium processing.

    I did the same thing . Except I returned my I94 while returning to US as the airlines did not take my I94. While returning I just explained my situation to immigration officer and she was knowlegable and issued a new I94.

    it is fairly common, if you used separate checks then look at the backs of cashed checks for case number else call USCIS.

    In my opinion you should be OK.

    I think since you have filed I-485 you are in adjustee status so you need not even be working for the company that filed your GC.

    Since your co. got acquired the new co. will have to do a H1 transfer and if USCIS raises any RFE regarding your I-485 app then the new co. can respond on behalf of the old co. with a letter saying that they have acquired the original filer co.

    If you get called for an interview at the time of GC approval then again you can take a letter of job offer from the new co. along with the letter of acquisition and you should be OK.

    My PERM and 140 under EB3 is already approved last year, (other Conuntry). I am in the process of filing EB2, MS +0, with same company: different postion and 30% job req changes, prevaling wage is different level. I did my MS before I joined this company. My lawyer is saying we should be fine: any suggestions.

    My I-94 has expired becoz it was issued up to my passport validity. If I have to renew it, is it a good option to cross border and get a new I-94, like going to Mexico or Canada. Please advice. I am not sure how to proceed. No one knows the procedure. Please if anyone knows, advice.

    Since your I-94 is already expired, you need to consult an attorney. Assuming that it wasnt expired..you could have re-entered from Canada/ Mexico using your new passport, assuming you have a valid visa, and they would have issued you a new I-94 at the border crossing.
